Divorce in Indonesia: What Happens to a Spouse Visa, ITAS, ITAP and Dependent Status?

A divorce does not have one universal effect on every Indonesian family stay permit. A spouse-based ITAS, an ITAP obtained through a mixed marriage, and a dependent permit linked to another foreigner have different legal bases. Identify the exact permit, sponsor and date of the divorce document before deciding whether to change sponsor, seek another route or leave Indonesia.

For families, the practical risk is treating a relationship change as a private matter while the Immigration record still names a spouse as the basis or sponsor. The record needs a deliberate review, especially when a permit expiry or trip is close.

TL;DR

  • Read the code and legal basis on each person’s own visa and stay permit; family members may have different statuses.
  • A spouse-based ITAS should be reviewed promptly after the marriage ends, because its underlying family basis may change.
  • Published Immigration guidance gives specific continuation and sponsor rules for an ITAP obtained through a mixed marriage.
  • A child’s status should be checked separately from either parent’s permit.
  • Do not wait until the stay permit expires to ask the local Immigration office about the correct transition.

About the Author: This guide draws on Atelix’s visa pre-qualification and document review process for applicants planning an Indonesia visa application.

Which status do you hold now?

Start with the actual permission, not the informal term “spouse KITAS.”

E31A describes a family visa for the spouse of an Indonesian citizen. E31B is a family route for the spouse of an ITAS or ITAP holder. A person who later obtained ITAP through a mixed marriage is in another position again. The end of the marriage can affect the sponsor and the reason for the stay, but the next step depends on which of these documents the person holds.

Make a timeline: marriage date, divorce decision or certificate date, visa and stay-permit expiry, re-entry permit status, and any planned travel. Get readable copies of the relevant documents. A lawyer or experienced local adviser can then ask the right Immigration office about the specific status rather than offering a generic answer.

What changes for a spouse-based ITAS?

An ITAS granted to join a spouse is tied to the family basis identified in the application.

Immigration law and service guidance recognise that a change in the underlying marriage can affect a stay permission. Do not assume the printed expiry date alone means the permit can be used without any update after divorce. Ask whether the current ITAS can be retained, changed to another qualifying basis, or must be ended and replaced. The sponsor or account holder may need to take part in that process.

Possible alternative routes depend on real facts: work with an authorised Indonesian employer, a qualifying investment, study or another family relationship. Holding a job offer or company shares does not itself change the existing permit. The new route has its own sponsor, documents and approval process.

Does an ITAP survive divorce?

Published Immigration guidance distinguishes an ITAP from a mixed marriage that lasted at least ten years from one that ended sooner.

An Immigration office’s guidance says an ITAP obtained through a valid mixed marriage can remain valid after divorce when the marriage lasted ten years or more, while an Indonesian individual sponsor is still required. For a marriage lasting less than ten years, the same guidance says continuation depends on obtaining an Indonesian individual sponsor. It describes a 60-day period, counted from issuance of the divorce certificate, to propose the sponsor to the local Immigration office; failing that can lead to cancellation.

Those are important legal distinctions, not a promise that every individual permit remains valid without action. Have the local office confirm the documents, timing and process for the particular ITAP. If you hold an ITAS rather than an ITAP, do not apply the ITAP continuation rule to your case.

What happens to children and other dependants?

Review each person’s permit, nationality and family basis separately.

A child with an E31C or other family permission may have a different sponsor and different legal relationship from a spouse. A foreign child of an Indonesian parent is not automatically in the same position as a child who joined a foreign ITAS holder. Custody, the child’s nationality and the sponsoring parent can all affect the appropriate route.

Prepare the birth certificate, passports, stay permits, custody or court records and current sponsor documents. An adult should not assume that a child’s permission ends or survives solely because the adult spouse visa changes.

What should you do first?

Act on the documentary dates and obtain a case-specific status check before travel or a new filing.

  • Identify: List every family member’s visa code, ITAS or ITAP number, sponsor and expiry date.
  • Document: Keep the marriage record, divorce certificate or decision, and any child or custody documents.
  • Confirm: Ask the local Immigration office which notification, sponsor-change or status-change process applies.
  • Plan: Check whether an alternative route is available before ending the present one.
  • Record: Keep written confirmation of the advice and of any application submitted.

This is a situation where a traditional visa agent with strong local office knowledge, or a qualified immigration professional, may be more useful than a self-service workflow alone. Atelix can organise the route and document pre-qualification, but the final status decision belongs to Immigration.

Frequently Asked Questions

Does divorce immediately cancel every spouse visa?

No single answer covers every permit. The effect depends on whether you hold ITAS or ITAP, how it was obtained, the sponsor and Immigration’s decision. Seek a status check promptly.

Is the ten-year marriage rule for every family permit?

No. The published rule discussed here concerns ITAP obtained through a mixed marriage. Do not apply it automatically to an ITAS or a foreign-spouse dependent route.

When does the 60-day sponsor period start?

The cited Immigration guidance counts it from issuance of the divorce certificate for the specified ITAP situation. Confirm the applicable date and documents with your local office.

Can I switch from a spouse route to a work route?

Potentially, if you meet the work route’s conditions and the correct transition is approved. A new employer or contract alone does not authorise work.

What about my child’s permit?

Check the child’s code, nationality, sponsor and legal relationship independently. Family members do not necessarily share one immigration outcome.
